FAA Reopens Comment Period on BVLOS Operations

The FAA is reopening public comment on its proposed rule for drone Beyond Visual Line of Sight (BVLOS) operations, focusing specifically on electronic conspicuity and right-of-way issues. The FAA is seeking input on alternative electronic conspicuity (EC) devices in comparison to available ADS-B Out technologies and current regulations and allowances. Comments are open for 14 days.

The 2025 proposal received 3,100+ comments, with over half addressing controversial right-of-way rules that would give drones presumptive right-of-way over manned aircraft in certain conditions. Concerns raised include the complexity of varying right-of-way rules, practicality of requiring manned aircraft to yield to drones, and cost of detect-and-avoid technology. NATA continues to work with industry partners to provide input from the business aviation perspective and appreciates the additional time to address key concerns.
