Congressional Transportation Leaders Release Compromise FAA Reauthorization – House Vote Expected Wednesday
|
|
Early Saturday, House and Senate transportation leaders released the text of a 1,200 page compromise bill (HR 302, FAA Reauthorization Act of 2018) to reauthorize the FAA for five years and provide $96.7 billion in funding. This compromise bill (which combines the House and Senate FAA bills) drastically shortens the process towards enactment into law and sets Congress and the Administration up for a legislative win before congressional adjournment for the midterm elections. While the majority of the bill focuses on FAA reauthorization, other bills have been included that support the needs of NTSB, maritime, TSA and disaster relief for states affected by Hurricane Florence. The compromise legislation contains many issues supported by NATA, including efforts to ensure regulatory consistency, combat illegal charter, encourage the next generation of aviation maintenance technicians, and promote the Piston Aviation Fuels Initiative (PAFI). The House is scheduled to take up this massive bill on Wednesday at noon and send it to the Senate for immediate consideration. If all goes according to plan, it’s estimated that a final Senate floor vote will occur sometime Friday and be delivered to President Trump for enactment into law on Saturday, avoiding an expiration of funding authority and a sixth short-term extension. DOT Broker Rule Increases Consumer Protections, Transparency | Regulations Include NATA-Submitted Recommendations
|
|
Last Wednesday, NATA urged its members to review and prepare for the application of new Department of Transportation (DOT) standards related to the sales of charter flights. The DOT's newly-released regulations impact air charter transactions that are constructed to provide formal structure within which air charter brokers may operate, increase transparency in transactions, enhance protection for consumers and strengthen enforcement capabilities.
The final rule, “Increasing Charter Air Transportation Options,” which goes into effect February 14, 2019, establishes a new class of indirect air carrier known as “air charter brokers.” The DOT has maintained similar rules for disclosures, refunds and prohibited actions that apply to air charter operators. The regulations have been under consideration since at least 2007 when the DOT was prompted to act following safety recommendations issued by the National Transportation Safety Board.
Jacqueline Rosser, NATA’s Regulatory Affairs Senior Advisor, stated, “for well over a decade the air charter industry has called for better oversight of transactions involving brokers, who typically are not commercial aircraft operators but facilitate charter agreements between consumers and operators. Connecticut Governor Dannel Malloy Declares September 2018 “General Aviation Appreciation Month”
|
|
Last week, NATA and other leading aviation trade associations commended Connecticut Governor Dannel Malloy for declaring September 2018 “General Aviation Appreciation Month” across the state. According to the Alliance for Aviation Across America, Connecticut contributes over $7.4 billion to the state’s total economic output and the state’s 20 public-use general aviation airports serve 4,810 pilots and 1,613 active general aviation aircraft. Tim Obitts, NATA’s Executive Vice President and General Counsel, noted that general aviation and local airports support well-paying jobs and communities throughout the state. “We thank Governor Malloy for issuing this proclamation and recognizing the value of general aviation businesses and local airports across Connecticut,” he stated.

FAA Fly Safe: Prevent Loss of Control Accidents
|
|
Last week, the FAA released a newsletter about their #FlySafe campaign, which educates GA pilots about the best practices to calculate and predict aircraft performance and to operate with established aircraft limitations. This push has gained a great deal of attention because in the recent 10-year period, there were more than 1,200 fatal loss-of-control accidents. A Loss of Control (LOC) accident involves an unintended departure of an aircraft from controlled flight. To avoid LOC, stabilized approaches are crucial, such as a constant speed and consistent descent rate. The FAA’s Acting Administrator, Daniel Elwell stated, “The FAA and industry are working together to prevent LOC accidents and save lives. You can help make a difference by joining our #Fly Safe campaign. Every month on FAA.gov, we provide pilots with Loss of Control solutions developed by a team of experts — some of which are already reducing risk.” Read more about the FAA’s initiatives to avoid LOC here.

Jet Aviation Becomes First in Puerto Rico to Achieve IS-BAH Registration

Last week, Jet Aviation’s San Juan location announced its completion of the International Standard for Business Aircraft Handling (IS-BAH) registration. San Juan now joins the eight Jet Aviation FBOs in the U.S. and the 13 FBOs in EMEA and Asia that have achieved IS-BAH certification. The International Standard for Business Aircraft Handling (IS-BAH) is a set of global industry best practices for business aviation ground handlers that features at its core a safety management system (SMS). The IS-BAH follows the long-established structure of the International Standard for Business Aircraft Operations (IS-BAO) Program and incorporates the NATA Safety 1st Ground Audit Program.
