Senate Moving on FAA Reauthorization Bill

Last week, the Senate voted unanimously to begin consideration of S. 2658, the Federal Aviation Administration Reauthorization Act of 2016, allowing Senators to begin floor debate and offer amendments. The vote comes after numerous closed-door discussions on incorporating into the bill unrelated renewable energy tax provisions. Many Senators are encouraging the inclusion of additional airport security measures into the bill following the terrorist attacks in Brussels, including heightened passenger screening systems and TSA access to additional terrorism-related databases as well as provide the agency a boost to expand upon its TSA PreCheck program. The reauthorization bill would extend the FAA’s authority to operate through October 1, 2017. Watch ongoing Senate debate on the reauthorization legislation here.

FAA, EASA Extend 8130-3 Requirement

The “new” parts documentation requirement imposed on U.S.-based production approval holders by Change 5 to the United States-European Union Maintenance Annex Guidance (MAG) has once again been postponed. The new effective date is October 1, 2016 – six additional months to fully realize the benefits of the new 14 CFR § 21.137(o). The MAG details EASA, FAA, and applicant actions required to be taken in order for an FAA-certificated 14 CFR part 145 repair station primarily located in the U.S. to be approved to EASA Part-145; and for an EASA Part-145 Approved Maintenance Organization to be approved to 14 CFR part 145, in accordance with the Agreement between the United States of America and the European Community on Cooperation in the Regulation of Civil Aviation Safety. NATA and other trade associations worked with the FAA to revise the MAG language. As a result, the FAA and EASA agreed to allow implementation of the privileges under 21.137(o) to the greatest extent possible, and agreed to extend the implementation deadline specified in FAA Notice 8900.336 from April 1, 2016 to October 1, 2016. All of the other provisions of MAG CHG 5 remain in effect.
