Court Blocks Department of Labor’s New Overtime Rule
|
|
Last Tuesday, a U.S. District Court granted a nationwide preliminary injunction to the Department of Labor’s overtime exemption rule scheduled to go into effect on December 1st. NATA filed in opposition to the proposal last year noting it “will inhibit the promotion of employees to management positions and return some current managers to hourly status.” The rule states no employee with a guaranteed salary of less than $47,476 will qualify as exempt under the executive, administrative, or professional exemptions. The current minimum salary level is $23,660. The Department of Labor still has the option to appeal to the New Orleans, Louisiana-based 5th U.S. Circuit Court of Appeals. |
